Grays ‘Win A Case’ Promotion

Terms and Conditions

1. Information on how to enter and the prize details form part of these terms and conditions. Participation in the "Grays ‘Win A Case’ Promotion" (Promotion) is deemed acceptance of these terms and conditions.

2. The Promotion commences at 8am (AEST) on 7 June 2021 and closes on 30 June 2021 at 11:59pm (AEST), unless extended at the Promoter's discretion (Promotion Period).

3. The Promotion is conducted by Grays eCommerce Group Limited (ACN 125 736 914) of 376 Newbridge Road, Moorebank NSW 2170 Australia (Promoter).

Eligibility

4. Entry is only open to residents of Australia aged 18 years or over who are registered users of Grays website during the Promotion Period.

5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

6. Residents of Northern Territory (NT) are not eligible for this promotion.

Entry

7. To enter the Promotion, an entrant must during the Promotion Period have a registered Grays account from http://www.grays.com/

8. Entries are issued through the purchase of wine, beer or spirit from Grays Auction or “Buy It Now”. There can be unlimited entries provided in this way. One entry is granted to the Grays User for each bottle or case of wine, beer or spirit purchased during the promotion period. 

9. Entries received will be entered into the draw digitally, regardless of the Entrant’s geographical location.

10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Prize Draw

11. There will be a single prize draw conducted using computerised random selection. The prize draws will take place at St Leonards Address [CR1] at 11am (AEST) on the dates specified in the table below.

12. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.


13. The winner will be notified in writing and via phone within 2 business days of the draw and their name will be published online at https://lp.graysonline.com/competition/  one week after the applicable draw date, for a minimum of 28 days.

Prizes

14. There will be one winner per draw who will win a Case of Wine – Cullen Diana Madeline Cabernet Merlot 2002/2003/2004 (6x750mL), WA. The awarded, the Promoter is not liable for the prize being lost, stolen, forged, damaged or tampered with in any way. The Promoter will organise and pay for transport and or postage of the Prize to the winner if they choose. The prize may not be sent to the Northern Territory or outside of Australia.

15. Total prize pool is valued at $999. The prize value is in Australian dollars.

16. If for whatever reason a winner does not take or claim the prize by the time specified by the Promoter, then the prize will be forfeited and the Promoter is not obliged to substitute the prize.

17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

18. f the prize is unavailable, for whatever reason, the Promoter in its discretion, reserves the right to substitute the prize for a prize of equal or greater value.

14. A draw for any unclaimed prize(s) may take place on 7 July 2021 at the same time and place as the original draw, subject to any directions from a regulatory authority. A winner(s), if any, will be notified in writing and via phone within 2 business days of the re-draw and their name(s) will be published online https://lp.graysonline.com/competition/ on 14 July 2021, for a minimum of 28 days.


General

20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

21. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at https://www.grays.com/content.aspx?block=privacy-policy. The Privacy Policy also contains information about how entrants may opt out of receiving direct marketing material from the Promoter, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All Entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (see the Promoter's Privacy Policy for details).

22. The Promoter is not liable for any technical error that may occur during the Promotion that is outside of the Promoter's reasonable control. This includes, but is not limited to, any omission, interruption, deletion, defect or delay in operation or transmission or failure of any telephone, mobile or satellite network.

23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of/taking/redeeming a prize.

25. The Promoter’s decision is final and no correspondence will be entered into.

26. In the event of war, terrorism, state of emergency, pandemic conditions or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant Australian regulatory authority.

27. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b), to modify, suspend, terminate or cancel the Promotion, as appropriate.

28. It is a condition of accepting any prize that, if requested by the Promoter, a prize winner must verify by statutory declaration that their winning entry complies with, and they agree to be bound by, these terms and conditions.

29. An entrant may at any time request that he or she be withdrawn from the Promotion, and the Promoter must use its reasonable efforts to withdraw the entrant as soon as practicable.

30. If a provision of these terms and conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these terms and conditions. All other provisions of these terms and conditions remain in full force and effect.

31. The agreement created under these terms and conditions is subject to the laws of Victoria, and entrants and the Promoter submit to the non-exclusive jurisdiction of the courts of that State.
